Bystanders at Constitution Beach saw a disturbing scene on Monday that prompted calls to local police.
Police say Mikel Hilerio, 29, threw his girlfriend's 4-year-old twins into the water at the beach. The twins have both been diagnosed with Autism.
A defense attorney for the man says his client was "just playing" with the children.
But police tell a different story... Prosecutors say the man admitted to being under the influence of heroin at the time of the incident.
It is still under investigation by The Department of Children and Families. "I believe Hilerio was endangering both children by allowing them to be in the water and by violently throwing at least one of them in multiple times," an officer wrote in the report.
The children were uncontrollably shivering and taken to a nearby hospital for evaluation.
